Dear Diane, my ex and I weren’t married, can we still do property settlements?
Yes, you can do property settlements – as long as you meet some requirements. The law provides both married and de facto couples the ability to finalise their property matters through the Court.
For your relationship to be considered a de facto relationship, you need to be able to demonstrate that you and your former partner were living as a couple, and the relationship was at least 2 years, you have a child together or you have made substantial contributions to the relationship and it would result in ‘significant injustice’ if the Court did not make Orders to distribute your property.
